These Terms of Service ("Terms") govern the use of the Elevate Analysis Video Portal, a sports video and analysis streaming platform ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Platform.
1. Account Registration
1.1 You must be a member of a registered sports team to create an account on the Elevate Analysis Video Portal.
1.2 Each sports team account may have multiple individual profiles associated with it, each linked to a team member ("User").
1.3 By registering an account, you confirm that you are authorised to represent the sports team and its members.
2. Purpose of the Platform
2.1 Elevate Analysis Video Portal is intended for sports video analysis, team collaboration, and providing on-demand access to game footage for team supporters.
2.2 Users may upload, analyse, and share sports videos for the purposes of team analysis, improvement, and engaging team supporters.
3. Account Usage and Security
3.1 Each team account is for the exclusive use of the registered sports team and its members.
3.2 Users must keep their login credentials confidential and not share them with others.
3.3 Users are responsible for all activities that occur under their account, and must promptly notify Elevate Analysis of any unauthorised use or security breach.
3.4 Elevate Analysis may monitor account usage for unexpected activity to prevent unauthorised use or account sharing.
4. Prohibited Activities
4.1 Account sharing is strictly prohibited. Each User must have their own individual profile linked to the team account.
4.2 Users must not attempt to access, use, or disrupt the accounts of others.
4.3 The Platform must not be used for any illegal, unauthorised, or improper purposes.
5. Intellectual Property
5.1 Elevate Analysis retains all rights to the Platform and its content, including but not limited to videos, analysis tools, and features.
5.2 Users retain ownership of the videos and content they upload to the Platform.
5.3 By uploading content to the Elevate Analysis Video Portal, Users grant Elevate Analysis a non-exclusive, royalty-free license to use, modify, reproduce, and distribute the content for the purpose of providing and improving the Platform.
6. Video Content Management
6.1 Elevate Analysis reserves the right to add, remove, or modify video content on the Platform at its own discretion.
7. Subscription Plans
7.1 Sports teams, clubs, and organisations can subscribe for a "Team Account" for the duration of their sports seasons which is managed by designated Team Admin who can add and remove all relevant team members throughout the duration of the Team’s subscription.
7.2 Team and club supporters (e.g., parents or non-active team members) can subscribe to access their team's game footage for the season. The subscription is a 6-month plan and auto-renews after each six (6) month period unless cancelled.
7.3 Supporter subscribers can cancel a subscription at any time through the user profile and selecting the details of the active subscriptions.
7.4 Self-service supporters who subscribe to the service may cancel their subscription and receive a full refund within five (5) days after purchasing the (6-month) subscription.
8. Privacy Policy
8.1 Data Collected: Elevate Analysis may collect various types of data from Users, including account information, , submitted and uploaded content, and other information that may be voluntarily submitted or automatically collected (e.g., usage data, device information).
8.2 Financial Information: For subscription purposes you may need to provide a valid payment method. Your payment information will be collected and processed by our authorised payment vendors, we do not directly collect or store credit or debit card numbers ourselves.
8.3 How We Use Your Data: We use collected data for purposes such as identification and authentication, operating our services, communication with Users, improving the platform and associated services, exercising our rights (e.g., enforcing Terms of Service), legal compliance, and protecting User information.
8.4 With Whom We Share Your Data: We may share your data as instructed by you or with your consent. We may also share data with analytics providers, to monitor account activity and to comply with legal obligations.
9. Termination
9.1 Elevate Analysis reserves the right to suspend or terminate any account that violates these Terms or engages in prohibited activities.
9.2 Users may terminate their account at any time by contacting Elevate Analysis support.
10. Disclaimer of Warranties
10.1 Elevate Analysis provides the Platform "as is" without warranties of any kind, express or implied.
10.2 Elevate Analysis does not guarantee the accuracy, completeness, or reliability of any video content or analysis hosted on the Platform.
11. Limitation of Liability
11.1 Elevate Analysis shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Platform.
12. Changes to Terms
12.1 Elevate Analysis reserves the right to modify or update these Terms at any time. Users will be notified of any significant changes.
13. Governing Law
13.1 These Terms shall be governed by and construed in accordance with the laws of New Zealand.
